Conditions of Sales

This Conditions of Sales, taken together with our Privacy Policy and Terms of Use (and any other documents referred to in them) constitute Ali&Co Genève SA (hereinafter « Ali&Co »)’s Terms and Conditions and govern all interaction between Ali&Co and users of the website www.aliandco.com (hereinafter the « Website »). We reserve the right to immediately bar access to the Website and close the account of any user who violates this provision or any other provision in these Terms and Conditions.

1. General information

This Conditions of Sales contained herein apply to all products and services sold exclusively through the Website. They define the rights and obligations of the parties.

Ali&Co reserves the right to modify at any given moment the content and form of these Conditions of Sales.

The inclusion of any products or services on the Website at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product or services at any time.

2. Prices and delivery charges

The prices mentioned for each product on the Website shall be understood as including all taxes, but excluding expenses of preparation or delivery. The delivery expenses of the order shall be indicated prior to the final confirmation of the order.

Ali&Co reserves the right to modify, without prior warning and at any moment, the prices and other fees published on the Website. However, the products will be billed to the customer on the basis of the tariffs in force at the moment of the confirmation of the order.

The prices applicable to the users and customers are those valid for the country in which he will indicate a delivery address. Prices in store, catalogue and online may vary.

3. Orders

Once the desired product has been chosen, it is placed in the “shopping cart”. The customer may then continue his selection of products, modify his shopping cart or proceed with the payment of the order. The confirmation of the order by the customer serves as acceptation of the Conditions of Sales

Once the order confirmed and paid, the customer receives by e-mail a confirmation of his order.

If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will contact you to settle the refund.

4. Depiction of the products

Ali&Co shall endeavour to ensure that the products and services sold through the Website are depicted by photographs with the highest possible accuracy. However, due to the mode of presentation of these products on the Internet, it is possible that the perception of the customer of the photographic depiction of the products does not exactly correspond to the products themselves.

5. Secure payments

The payment of the orders is performed through a payment card or bank wire. The payment cards accepted to this day are: Paypal.
The order will be considered effective upon receipt of the approval by the bank payment centres.

In accordance with applicable legislation and to ensure the security and privacy of the customers’ information, Ali&Co does not memorize the banking data of the customers. It is therefore up to the customer to save and print his certificate of payment if he wishes to preserve the details of the payment related to his order.

6. Delivery

Ali&Co guarantees the expedition of the products and services sold through the Website to Switzerland, France, and to no other country. The products and/or services will be sent to the delivery address indicated by the customer during the order process.

We will confirm the shipping date (including tracking number) by issuing you a shipping notice.  Delivery will normally take place within 2-5 days (but subject to a maximum of 30 days) days after the date of order unless specifically otherwise agreed at the time of making the order.

Delivery fees are calculated at the end of the order process, on the basis of the delivery country, weight, volume and the tariffs of the carrier.

For any delivery outside Switzerland, you will have to bear any Custom duties and other taxes applicable in your country; these additional costs are not included in the prices indicated on the Website. By accepting these Conditions of Sales, you agree to pay any taxes that may apply in your country.

7. Acceptance of the products

Upon reception of the product, you shall have a right of withdrawal to be exercised within a term of 14 days by returning the delivered product, the return expenses being supported by the customer. Only the products bought through the Website, and in the same condition they were in upon your receipt, may be refunded. This means the items should not have been damaged, altered or worn (other than to try the item on) and that any labels or tags should be intact.

Shipping & handling fees are non-refundable, except for defective or wrongly shipped items. 
Items must be returned in their original packaging, including accessories, extra loops, and anything else that came with the item. Batteries, straps (plastic, leather, or metal) and reduced priced items (reduced retail price, special promotions, sales etc) are considered 'Final Sale.' Final Sale items are non-refundable, non-exchangeable, and may not be redeemed for cash unless required by law, or the merchandise is damaged or defective upon delivery.

The procedure is as follows:
Items must be returned in their original packaging, including accessories, extra loops, and anything else that came with the item.

Upon reception and after examination by the Ali&Co, the price of the item, excluding handling and shipping costs, will be credited back to you through the same mean of payment used for the purchase.

8. Warranty and repairs

All watches offered for sale on this Website have the benefit of the Ali&Co Genève SA International Warranty to be free from material or manufacturing defects for 24 months. The full warranty terms are in the International Warranty document provided with each watch.

The warranty does not cover normal wear, accidental damage, damage arising from improper use or shocks, or loss.

The customer may contact Ali&Co for any request for information or estimate for repair, but only for the products bought through the Website.

Upon invitation by the Ali&Co, the customer may be requested to send back, at his own expenses, the watch to Ali&Co.

After examination by the Ali&Co:

• If the repair is covered by the warranty, the product shall be automatically repaired and sent back to the client free of charge
• If the repair is not covered by the warranty but amounts to less than 50.-- CHF, the product shall be automatically repaired, then billed and returned to the client after payment. The delivery expenses will also be billed to the client.
• If the repair is not covered by the warranty and amounts to more than 50.-- CHF, the Customer Service shall provide the customer with an estimate.

The necessary time to perform the repair shall be announced by Ali&Co on a case-by-case basis.

9. Miscellaneous

Modification to the Website:  We reserve the right, for any reason, in our sole discretion and without notice to you, to terminate, change, suspend or discontinue any content, any aspect of the Website, and/or its hours of availability, and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Website or restrict your access to part, or all, of the Website without notice or penalty. We have the right to change these rules and/or limitations at any time, in our sole discretion.

Liability: Ali&Co is not liable for any damage, unless such damage has been caused by intent or by gross negligence. In no event shall Ali&Co be liable for indirect damage. If Ali&Co, notwithstanding the foregoing, is liable for damage, then liability will be limited to the purchase price of the goods. The above liability limitations apply to all claims for damages no matter what the legal grounds may be; they do not apply to potential liability according to the regulations on product liability. The rights of the consumers based on the consumer protection laws in force are not affected. The exclusion or the limitation of the liability for damages according to the above paragraphs also applies to potential claims against employees or authorized representatives of Ali&Co.

Assignment: You may assign your contractual rights to a third party only with Ali&Co’s prior written consent.

Severability:  If any part of these Conditions of Sales or any provisions of an Agreement shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law these Conditions.

No Waiver:  Failure of Ali&Co to exercise any rights or remedies will not constitute a waiver of any rights or remedies available to Ali&co under the Conditions of Sales or at law.

Entire Agreement:  The Terms and Conditions represent the entire agreement between Ali&co and users /customers and supersede and replace any other agreement between the parties (including but not limited to any prior versions of the Terms and Conditions).

10. Applicable law

Any litigation or dispute arising from or in connection with these Conditions of Sales or with any sale to which they apply will be settled in accordance with Swiss law, without reference to its conflict of laws principles. The Courts of the Canton of Geneva shall have exclusive jurisdiction on such dispute.
